GENERAL TERMS AND CONDITIONS

Operator: AVIA PARK III s.r.o. with its registered office at Beranových 140, Prague 9, Postal Code 199 00, ID No.: 28364139, VAT No.: CZ28364139, Section C, Insert 136300, registered with the Municipal Court in Prague for the purchase of hotel services, gift stays and value vouchers of BLUE ORANGE RESORT through the on-line shop located at www.blueorange.cz

1. Introductory provisions

1.1 These General Terms and Conditions (hereinafter referred to as "GTC") regulate the rights and obligations between the operator Blue Orange Resort (hereinafter referred to as "Resort") and its clients (hereinafter referred to as "Guest").

1.2 By entering into a contract for accommodation, booking services or other related products, the Guest confirms that he/she agrees to these GTC.

2. Reservation and payment

2.1 Reservations may be made online, by telephone, by email or in person.

2.2 Pre-payment or a credit card guarantee may be required to confirm a booking.

2.3 The Resort reserves the right to change prices if the booking has not already been confirmed by the Guest.

3.1 Cancellation of a complimentary booking is subject to the cancellation policy stated on the booking confirmation.

3.2 In case of late cancellation or no-show, a penalty of 100% of the total price of the reservation may be charged, provided that the Guest has been informed of this fact in the booking confirmation.

4. Accommodation and stay

4.1 Check-in is possible from 15:00, check-out until 10:00, unless otherwise agreed.

4.2 The Guest is obliged to observe the operating rules of the Resort and to keep quiet at night.

4.3 The Guest is responsible for any damage caused to the property of the Resort.

5.1 Complaints and claims must be reported immediately to the reception of the Resort.

5.2 The Resort undertakes to resolve the complaint within a reasonable period of time in accordance with applicable law.

6. Protection of personal data

6.1 The Resort processes Guests' personal data in accordance with applicable law and GDPR.

6.2 Personal data will not be disclosed to third parties without the consent of the Guests, except where the processing is necessary for the performance of a legal obligation of the Operator or the protection of the legitimate interests of the Resort.

7. Out-of-court dispute resolution

7.1 The Guest has the right to submit a proposal for out-of-court settlement of such dispute to the designated consumer dispute resolution body, which is:

7.2 The Czech Trade Inspection Authority is a supervisory authority exercising supervision over consumer protection pursuant to Act No. 64/1986 Coll., on the Czech Trade Inspection Authority, as amended, and other legislation. The website of the Czech Trade Inspection Authority is www.coi.cz.

8. Right of withdrawal

8.1 Pursuant to the provisions of Section 1837(j) of Act No. 89/2012 Coll., the Civil Code, the accommodated person as a consumer does not have the right to withdraw from the accommodation contract if the accommodation facility provides the performance within the specified period.

10. Final provisions

10.1 The Resort reserves the right to amend these GTC. The Guest will be informed of changes via the website.

10.2 All disputes will be resolved according to the laws of the Czech Republic.

11. Legal notice

11.1 The Resort shall not be liable for any damages arising from the use of the services or information contained in the GTC unless caused intentionally or by gross negligence.

11.2 All contents of the GTC, including texts, graphics, logos and other elements, are protected by copyright and other intellectual property laws. Any unauthorized copying, distribution or other use of the content without the prior written consent of the Operator is prohibited.

11.3 These T&C shall take effect on 31.3.2025 and shall remain in force until amended or replaced by a new version.

11.4 The Provider reserves the right to unilaterally modify or change the GTC at any time, the current version is always available at www.blueorange.cz.

11.5 The GTC shall be governed by the applicable law of the Czech Republic. Any disputes arising under or in connection with these Terms and Conditions shall be settled before the competent courts of the Czech Republic.

11.6 By using the Provider's website and services, the User agrees to these Terms and Conditions. Any violation of these terms and conditions may lead to restriction or cancellation of access to the services of the provider.
